Terms of Service

Acceptance of these terms
By using modestotreecare.com (the "Site") or submitting a request through it, you agree to these Terms of Service and to our Privacy Policy. If you don't agree, please don't use the Site.
Who we are, and who we aren't
Modesto Tree Care connects Stanislaus County homeowners with independent, local tree service providers. We are not a tree service and do not perform tree work ourselves — providers are independently owned and operated, and we recommend verifying licensing and insurance directly with any provider before hiring.
Modesto Tree Care does not hold a California contractor's license, does not employ tree workers or arborists, and does not quote, perform, supervise, or guarantee any tree work. Any contract for tree services is solely between you and the independent provider you choose to hire.
Eligibility
You must be at least 18 years old to submit a request through the Site or to participate in our SMS program. By submitting a request, you represent that you are 18 or older and that the contact information you provide is your own or that you are authorized to provide it.
SMS / text messaging program
Program description. When you opt in by checking the consent box on our request form, Modesto Tree Care and the independent provider(s) matched to your request may send you text messages about your inquiry — for example, to confirm we received it, to let you know a provider will be contacting you, or to follow up on scheduling. These are conversational and customer-care messages related to your request, not promotional campaigns.
Message frequency varies depending on your request. Message and data rates may apply. Check with your wireless carrier for details about your plan.
Opting out. Reply STOP to any message to stop receiving texts from that number. You may receive a single confirmation message that you have been unsubscribed. Reply HELP for help, or contact us through the contact page.
Consent is not a condition of purchase. You can submit a request and hire a provider without agreeing to receive text messages.
Carrier disclaimer. Wireless carriers are not liable for delayed or undelivered messages. Message delivery is subject to effective transmission from your network operator and may not be available in all areas.
Your consent names the receiving parties. When you opt in, your consent covers Modesto Tree Care and the specific independent provider(s) matched to your request. If your request is later matched to a different provider, that provider will obtain its own consent before sending you automated marketing messages.
The referral and matching service
Our service is free to homeowners. When you submit a request, we pass your details to one or more independent providers who serve your area and handle the type of work described. Providers contact you directly. We don't control, and aren't responsible for, a provider's availability, pricing, workmanship, licensing, insurance, scheduling, or conduct. We recommend verifying any provider's CSLB license at cslb.ca.gov and requesting proof of insurance before hiring, and getting the scope and price in writing.
Informational content
The cost ranges, permit information, licensing facts, tree-health guidance, and company comparisons on the Site are provided for general information, are dated, and may change. They aren't quotes, arborist assessments, legal advice, or endorsements. Prices for your specific tree can only be set by a provider who has seen it. Always confirm permit requirements with the relevant city or county before removing a tree.
No guarantee of results
We don't guarantee that a provider will be available for your request, that any provider will contact you within a particular time, or that you'll be satisfied with a provider's work. We make reasonable efforts to work with providers who serve your area and confirm their licensing, but we don't warrant any provider's qualifications.
Acceptable use
Don't submit false information, submit requests on behalf of someone who hasn't authorized it, scrape or copy the Site's content for republication, or interfere with the Site's operation.
Limitation of liability
To the fullest extent permitted by law, Modesto Tree Care is not liable for any indirect, incidental, consequential, or punitive damages, or for any damages arising from work performed by an independent provider, your reliance on information published on the Site, or your use of the Site. The Site is provided "as is" without warranties of any kind.
Governing law
These terms are governed by the laws of the State of California, without regard to conflict-of-law principles.
Changes to these terms
We may update these terms from time to time. The effective date at the top reflects the current version, and continued use of the Site after a change means you accept the updated terms.
